Terms and conditions

1. Definitions

In this document the following words will have the following meanings:

  1. Customer means an individual, partnership, limited company, charity or organisation that purchases services from the supplier.
  2. Supplier means Silver Tail Mastering of 33 Kentwell, Staffordshire, B79 7UB with the email address here.
  3. Contract means instructions, confirmed in electronic format, issued by the supplier and agreed upon by the customer for the supply of services.
  4. Services means the services that are advertised on the website including any of the number and description set out in the order
  5. Website means our website www.silvertailmastering.co.uk where our services are advertised.
  6. Privacy policy is the terms outlined www.silvertailmastering.co.uk/privacy-policy detailing how we will deal with confidential and personal data.
  7. Order means the customer’s order for the services of the supplier.
  8. Fees means all charges and expenses that will be invoiced by the supplier to the customer.

2. General

  1. These Terms and Conditions shall apply to all contracts for the supply of services by the supplier to the customer and shall prevail over any other documentation or communication by the customer.
  2. Any variation to these Terms and Conditions shall be inapplicable unless agreed in writing by the supplier.
  3. Nothing in these Terms and Conditions shall prejudice any condition or warranty, express or implied, or any legal remedy to which the supplier may be entitled in relation to the Services, by virtue of any statute law or regulation.
  4. Nothing in these Terms and Conditions shall affect the customer’s statutory rights as a consumer.

3. Services

  1. The description of services on our website does not constitute a contractual offer to sell the services. When an order had been submitted on the website we hold the right to reject the order, although we will provide a reason without delay.
  2. The order process is set out on our website. Each step will allow you to amend any errors made before placing an order. It is your responsibility to check that your order is correct and that you wish to proceed with the information you have provided.
  3. Once a confirmation email is received a contract is formed between you and the supplier for the agreed services. We are not responsible for inaccurate information. You must ensure to contact us immediately if any information is incorrect.
  4. The supplier shall not be liable for failure to complete the work within the proposed timeline.

4. Fees and payment

  1. The fee for the service is as specified on the website. Fees and charges include VAT at the rate at the time of the order.
  2. Fees are based on the supplier’s current assessment of costs and are subject to amendment subject to clause 10 – cancellation and termination.
  3. Payment for the services is immediate at the time of order. You must pay credit/debit card, bank transfer or PayPal before the delivery of any service.

5. Customer responsibilities

  1. Provide the supplier with any information reasonably required by the supplier.
  2. Obtain all necessary permissions and consent which will be required before the commencement of the services, the cost of which is the sole responsibility of the customer.
  3. Comply with such other requirements as may be set out in the order or otherwise agreed between the parties.

6. Supplier's responsibilities

  1. The supplier shall perform the services with reasonable skills and care and to a reasonable standard in accordance with recognized standards and codes of practice.
  2. The supplier accepts all responsibility to fulfill the service that is within its control, by the agreed timescales and to a satisfactory standard.

7. Registration and data protection

  1. Information disclosed by the customer will be kept confidential and shared only with relevant staff providing the service as agreed.
  2. All information retained by Silver Tail Mastering will be processed strictly in accordance with the provisions of the Data Protection Act 1998 and its successors. Such information shall be held solely for the purposes of fulfilling the contract.
  3. The supplier will not transmit any personal data held on behalf of the client except where a) The transfer is a necessary part of the work undertaken to fulfill the contract or b) There is a requirement to do so by operation of the law. For example, if there is a situation where concerns are raised regarding the safety and well-being of the customer, or for the person for whom the service is provided.
  4. When registering to the website you are required to submit a username and password and are reasonable for all actions taken under that user name. Do not disclose your user name and password to any other party.
  5. We retain and use the information strictly under the privacy policy listed here www.silvertailmastering.co.uk/privacy-policy.
  6. We may contact you by email or other electronic communication methods which you agree to in these terms and conditions.

8. Delivery

  1. Any service ordered will be delivered electronically through a file transfer service.
  2. The supplier is not responsible for any loss of data during transfer however will endeavour to resupply if such failure occurs.
  3. In any case, regardless of events beyond our control, if we do not deliver the services within the agreed upon time, you can require us to reduce the fees or charges by an appropriate amount. Where appropriate this can be the full amount.

9. Liability

  1. Nothing in these Terms and Conditions shall exclude or limit the liability of the supplier for death or personal injury. However the supplier shall not be liable for any direct loss (e.g. loss of profit) or damage suffered by the customer howsoever caused, as a result of any delay in the work carried out, negligence, breach of contract or otherwise in excess of the price of the service.
  2. The supplier will not be held responsible for third party costs incurred by the customer for any reason whatsoever.

10. Cancellations and termination

  1. The customer may cancel the service by notifying the supplier by email within 14 days of the order.
  2. All work undertaken up to receiving cancellation must be paid for within the notice period.
  3. The supplier may terminate the service for any good reason within 14 days, giving reasoning via email.
  4. To exercise your right to cancel you can use the cancellation form listed at www.https://silvertailmastering.co.uk/terms-and-conditions or contact us by email.
  5. The cancellation period will expire after 14 days from the date that you order.
  6. The customer will be issued a refund providing certain conditions are met:
    • Your bank / Paypal account was illegally charged (fraud).
    • The work has not being completed. Depending on the amount of work completed to whether this would be a part or full refund.

11. Acceptance of terms

  1. By ordering any of the services listed on our website you agree to be bound by these terms and conditions.
